Fixation Video standard terms and conditions (last revised September 2009)
The client agrees to pay a deposit of 50 percent of the final cost upfront, with the final 50 percent due on the completion of the project.
In the event of cancellation of the project within 28 days of the expected start date, Fixation Video retains the initial 50 percent deposit paid.
Final videos are supplied only once final payment has been made, unless by prior arrangement.
The quote includes travel within London, Zone 1 - 5. Other expenses, such as accommodation and travel beyond London, will be billed separately at cost price.
Unless otherwise specified, files will be delivered as web resolution H.264 encoded files suitable for uploading to video sharing websites such as YouTube. If an alternative file format is required, this must be discussed and agreed before the project commences.
Standard definition and high definition files are available for an addition cost. If high definition files files are required, this must be requested before the project commences.
The files will be delivered via a downloadable website link, unless otherwise requested.
Once final payment has been made, the client has exclusive rights to use the video, although Fixation Video retains the copyright on any videos produced or footage shot and reserves the right to use any videos produced or footage shot for promotional purposes.
A preview file of the video will be supplied for comments. After these are communicated, the final version will be supplied for approval within five days.
Any preview files sent to the client for approval will be low resolution, reduced quality to enable fast transfer and will include a visible watermark showing the current revision number. Clients are not permitted to use any preview files for any purpose other than review and feedback and are explicitly prohibited from posting them on their on own website, video sharing websites or any hosting service.
Unless otherwise agreed, any videos produced will contain an ident up to ten seconds long at the end that includes the text ‘Made by Fixation Video’ and the website address www.fixationvideo.com which must not be removed. Unless previously agreed, this can be removed for a nomimal fee of £40 per video.
In the event of either party not being able to complete their role due to acts, events, omissions or accidents beyond their reasonable control (force majeure), said party will have no liability, permitting all reasonable steps have been taken.
